TERMS & CONDITIONS

1. Permitted Use of the Website

You may use the Website solely for lawful purposes and in accordance with these Terms. Permitted activities include reviewing campaign information, signing up for updates, volunteering, and making contributions as outlined below.

 

You agree not to:

  • Engage in any activity that interferes with the Website's functionality or security.

  • Use the Website for commercial purposes without prior written consent from the Committee.

  • Attempt to gain unauthorized access to any portion of the Website or related systems.

  • Post, upload, or transmit any content that is unlawful, defamatory, obscene, or infringing on third-party rights.

  • Violate any applicable local, state, or federal laws, including campaign finance regulations.

 

The Committee reserves the right to monitor usage and terminate access at its discretion for any violation of these Terms.

2. Contributions and Donations

The Website facilitates contributions to the Committee in strict compliance with Colorado campaign finance laws (Colo. Rev. Stat. § 1-45-101 et seq.) and federal regulations. All contributions are voluntary and subject to the following:

Eligibility

  • Contributors must be natural persons who are United States citizens or permanent residents.

  • Contributions from corporations, labor organizations, foreign nationals, federal government contractors, and certain entities are prohibited under Colo. Rev. Stat. § 1-45-103.5 and 52 U.S.C. § 30121.

  • Minors may contribute, but such contributions are attributed to their custodial parent or legal guardian.

 

Limits

Per the Colorado Secretary of State's contribution limits for the 2025 election cycle (effective through 2027, subject to adjustment under 8 CCR 1505-6 Rule 10.17), the maximum allowable contribution to a gubernatorial candidate committee per election cycle (primary and general combined) is:

Natural Person: $725

Business Entity (non-corporate): $725

Federal PAC: $725

Political Committee: $725

Small Donor Committee: $7,825

Political Party (state level): $789,060

These limits apply to the joint candidate committee for Governor and Lieutenant Governor. Contributions exceeding these limits will be refunded. Unexpended funds carried forward from prior cycles do not count toward these limits but are subject to reporting.


T&C provide you as the website owner the ability to protect yourself from potential legal exposure, but this may differ from jurisdiction to jurisdiction, so make sure to receive local legal advice if you are trying to protect yourself from legal exposure.

Processing and Verification

  • All contributions are processed through a secure third-party payment processor compliant with Payment Card Industry Data Security Standards (PCI DSS).

  • The Committee reserves the right to verify contributor eligibility and may request additional information to ensure compliance.

  • Contributions are considered received upon clearance and are reported via the Colorado Secretary of State's TRACER system in accordance with Colo. Rev. Stat. § 1-45-108.

  • No contribution creates a contractual relationship or guarantees any benefit, endorsement, or outcome.

 

Refunds may be issued at the Committee's discretion but are not guaranteed. For refund requests, contact the Committee at the address below.

3. User Content and Submissions

If you submit information through forms (e.g., volunteer sign-ups, contact inquiries, or email subscriptions), you represent that such content is accurate, truthful, and non-infringing. The Committee may use submitted information for campaign purposes, including outreach, in compliance with the CPA and CAN-SPAM Act (15 U.S.C. § 7701 et seq.). You grant the Committee a non-exclusive, royalty-free license to use such submissions for promotional and informational purposes.

4. Intellectual Property

All content on the Website, including text, graphics, logos, images, and software (collectively, "Materials"), is the property of the Committee or its licensors and protected by United States copyright, trademark, and other intellectual property laws. You may view and print Materials for personal, non-commercial use, provided you retain all copyright notices.  Unauthorized reproduction, distribution, or modification is prohibited.

"Victor Marx for Governor" and related marks are trademarks of the Committee. Any use requires prior written permission.

5. Privacy and Data Protection

The Committee is committed to protecting your privacy. Personal data collected via the Website (e.g., name, email, payment information) is handled in accordance with our Privacy Policy, which outlines:

  • Data collection and use practices.

  • Consumer rights under the CPA, including access, correction, deletion, and opt-out of targeted advertising.

  • Security measures to safeguard data.

 

If the Committee processes personal data of 100,000 or more Colorado consumers annually, additional CPA obligations apply, including data protection assessments for high-risk processing. For questions, refer to the Privacy Policy or contact us.

6. Disclaimers and Political Communications

The Website constitutes political speech protected under the First Amendment and is not an offer to sell securities or solicit investment. All communications on the Website comply with disclaimer requirements under Colo. Rev. Stat. § 1-45-108.3 and 8 CCR 1505-6 Rule 22, including "Paid for by Victor Marx for Governor Candidate Committee, [Committee Address], Victor Marx, Treasurer" on applicable materials.

The Committee makes no representations or warranties regarding the accuracy, completeness, or timeliness of Website content. Campaign positions and statements reflect the candidate's views and may change.

7. Limitation of Liability

To the fullest extent permitted by law, the Committee, its officers, directors, employees, and agents disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. The Website is provided "as is."

In no event shall the Committee be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Website, even if advised of the possibility thereof. Total liability shall not exceed the amount you contributed, if any.

8. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Colorado and applicable federal laws, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Denver, Colorado. You waive any objection to venue or jurisdiction.

9. Changes to These Terms

The Committee may update these Terms at any time. Changes will be posted on this page with the "Last Updated" date revised. Continued use of the Website after changes constitutes acceptance. Material changes will be notified via email if you have provided contact information.

10. Accessibility
